2. Services covered
These terms cover the services we offer, including:
- hire of 2, 4, 6, 8, 12 and 16-yard skips;
- rubbish removal and domestic or commercial clearances, including house, office, garden and garage clearances;
- wait-and-load services; and
- waste drop-off at our Ponthir yard.
The specific service, waste type, location, price and any additional requirements will be set out in your order confirmation, quote or other written agreement.
3. Orders and quotations
3.1 You may request a quote or place an order by telephone, email, WhatsApp, through our website or by another method we make available.
3.2 When asking for a quote, please give us accurate information about the service required, the waste, its approximate amount and weight, the site and access conditions, and any relevant hazards or restrictions.
3.3 A quote is based on the information you provide and is subject to any assumptions or conditions stated in it. If the actual work, waste or site conditions differ materially from those described, we may need to revise the quote. We will explain any change and obtain your agreement before carrying out extra chargeable work, except where urgent action is reasonably needed for safety or legal compliance.
3.4 A booking becomes a contract when we accept your order, normally by confirming it verbally, by email, text or through our booking system. Your contract includes these terms and the details agreed in your quote or order confirmation.
3.5 Delivery times and service dates are estimates unless we expressly agree a fixed time in writing. Skip deliveries are usually made within 24 hours, subject to availability, location, access, weather and other operational conditions.
4. Prices and payment
4.1 The price agreed for your order will be confirmed in your quote or booking confirmation. All prices we quote include VAT unless we expressly state otherwise.
4.2 There are no fuel charges. Delivery outside the 5-mile radius of our Ponthir yard, including delivery to Usk, Magor, Undy and Caldicot, costs an additional £50, unless we agree otherwise in writing.
4.3 Skip hire includes the first 14 days. After that, the additional hire charge is £25 per week. We will tell you if any other charge may apply, for example for an agreed extension, a permit, extra services or handling waste that is not permitted in the skip.
4.4 We accept major credit and debit cards and cash on delivery. The payment method and payment date for your order will be stated when you book or on the relevant invoice. You must pay any amount due by the date specified.
4.5 If you dispute an invoice, please contact us promptly and explain the reason. You must pay any part of the invoice that is not genuinely disputed by its due date.
4.6 If a business customer does not pay an undisputed sum by its due date, we may charge interest and compensation where permitted under the Late Payment of Commercial Debts (Interest) Act 1998. We will not charge a consumer an unfair or disproportionate late-payment fee.
4.7 We may suspend or delay work, delivery, collection or further services where a payment that is due remains unpaid, after giving reasonable notice where appropriate. This does not affect any rights you have under the law.
5. Delivery, access and placement
5.1 You are responsible for ensuring that the delivery and collection vehicle can safely and lawfully reach the site and that the proposed skip location is suitable. Please tell us in advance about narrow roads, low branches or cables, restricted access, parking restrictions, soft ground, slopes, gates, overhead obstructions or other relevant conditions.
5.2 You must ensure that the delivery area is clear and that you have permission to use the site and place a skip there. We may decline or postpone delivery if, in our reasonable opinion, access or placement is unsafe, unlawful or unsuitable.
5.3 You are responsible for obtaining any permit required to place a skip on a public road or other public highway, including any permit required under the Highways Act 1980 or by the relevant local authority. You must obtain it before delivery and comply with its conditions. If we agree to arrange a permit for you, you remain responsible for providing accurate information and for any permit fee or other amount agreed with you.
5.4 You are responsible for assessing whether the ground and surface can safely support the delivery vehicle and skip. You should protect driveways and other surfaces where appropriate. We will take reasonable care when delivering and collecting, but cannot guarantee that a surface will not be marked or damaged by the weight of the vehicle or skip, particularly where the surface is weak, uneven or unsuitable. This does not limit any liability that cannot lawfully be excluded.
5.5 If we cannot deliver or collect because of access, placement, permit or site conditions for which you are responsible, we may rearrange the service and charge a reasonable additional amount for wasted travel or extra work, where this was explained or agreed and is lawful.
6. Skip hire period and collection
6.1 The standard hire period is 14 days from delivery. If you need the skip for longer, contact us to arrange an extension. Additional hire after the first 14 days is £25 per week.
6.2 When the skip is full or you no longer need it, call us on 07525 034 980 to request collection. We aim to collect within 5 days of your call. This is an estimated service timeframe and may be affected by access, location, weather, operational conditions or other circumstances outside our reasonable control.
6.3 Keep the skip accessible for collection and do not move it or allow it to be moved without our permission. If you need the skip collected or moved from a public road, you must ensure that any applicable permit remains valid until it has been removed.
6.4 Do not continue loading a skip after it has reached the safe fill line. Loads must be level with the top of the skip and must not protrude above or beyond it. We may refuse to transport an unsafe or overloaded skip. You will be responsible for arranging, and paying any reasonable agreed costs of, removing excess waste or making the load safe.
7. Permitted and prohibited waste
7.1 You must only put waste in a skip or give us waste for removal that we have agreed to accept. You must tell us accurately what the waste contains and must not conceal, mix or misdescribe waste.
7.2 Unless we have expressly agreed in writing to accept a particular item or waste type and confirmed the arrangements and price, you must not put the following in a skip or present them for collection or yard drop-off:
- hazardous or specially controlled waste;
- asbestos or materials containing asbestos;
- fridges, freezers or other refrigeration equipment;
- tyres;
- electrical or electronic equipment;
- gas bottles or pressurised containers;
- chemicals, oils, paints, solvents or fuels;
- batteries;
- clinical or infectious waste;
- liquids, hot ash or burning materials; or
- any other waste that is prohibited by law or unsafe for us to handle.
If you are unsure whether an item is accepted, contact us before loading or bringing it to our yard.
7.3 You are responsible for segregating and presenting waste as we instruct. If prohibited, hazardous, misdescribed or unsuitable waste is found, we may refuse to collect, transport or accept it, or may make safe arrangements where reasonably necessary. We will explain any resulting additional cost and obtain your agreement before carrying out chargeable work, except where urgent action is reasonably required for safety or legal compliance.
7.4 We may refuse to transport a skip if it is overloaded, unsafe, improperly loaded or contains prohibited waste. You may be responsible for reasonable costs of making the load safe, removing prohibited material or arranging a further collection, where those costs arise from your breach of these terms and are lawful.
8. Your waste responsibilities and documentation
8.1 You must comply with applicable waste laws and your duty of care under section 34 of the Environmental Protection Act 1990. In particular, you must describe the waste accurately, take reasonable steps to prevent its escape and ensure it is transferred only to an authorised person.
8.2 You must not use our services to dispose of waste unlawfully or provide false or misleading information about its origin, composition or classification.
8.3 We will handle and transfer waste in accordance with our legal obligations and provide waste transfer documentation for each job where required. You must provide any information reasonably needed to complete that documentation accurately and keep any copy you are required by law to retain.
8.4 At our yard, waste acceptance is subject to inspection, the types and quantities we are authorised and equipped to accept, and our site rules. We may refuse a load that is prohibited, unsafe, misdescribed or unsuitable. Any yard charge will be confirmed before acceptance.
9. Damage and loss
9.1 You must take reasonable care of any skip while it is on your site, keep it secure and not interfere with, damage or move it. Please tell us promptly if it is damaged, stolen, moved or becomes unsafe.
9.2 You may be responsible for the reasonable cost of repairing or replacing a skip where damage or loss is caused by your negligence, deliberate act or breach of these terms. We will provide a reasonable explanation of any charge. You are not responsible for ordinary wear and tear or damage for which we are responsible.
9.3 We will take reasonable care of your property while providing the service. You should remove or protect items that could be damaged by the work, and identify any fragile surfaces, services or other particular risks before we begin.
10. Cancellation and changes
10.1 Please contact us as soon as possible if you need to change or cancel an order. We will explain whether a reasonable charge applies for work already carried out, costs already incurred or a failed attendance caused by circumstances for which you are responsible. We will not impose a cancellation charge that is unfair or disproportionate.
10.2 If you are a consumer and your contract was made online, by telephone, by email or otherwise at a distance, or away from our business premises, you may have a legal right to cancel within 14 days of entering into the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The law contains exceptions and the precise right may depend on the service and how the contract was made.
10.3 If you ask us to start providing a service during the 14-day cancellation period, you must make that request expressly. If you then cancel after the service has started, you may have to pay a proportionate amount for the service provided up to the time you told us you were cancelling, where the law allows. Your right to cancel is lost after the service has been fully performed only if the legal requirements are met, including your prior express consent for the service to begin and your acknowledgement that you will lose the right once it is fully performed.
10.4 To exercise a cancellation right, contact us clearly by email at info@mjrubbishremovals.co.uk or by telephone on 07525 034 980. You may use the following wording, but you do not have to:
I give notice that I cancel my contract for [describe the service], booked on [date].
Name: [Name]
Address: [Address]
Date: [Date]
10.5 Nothing in these terms removes or restricts any cancellation right or other consumer right you have under the law.
11. Our responsibilities and liability
11.1 We will provide our services with reasonable care and skill and in accordance with the description agreed with you.
11.2 Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any rights or remedies that a consumer has under the Consumer Rights Act 2015 or other applicable law.
11.3 Subject to clause 11.2, we are not responsible for loss or damage caused by inaccurate information you provide, unsafe or unsuitable site conditions, your failure to follow these terms, or events outside our reasonable control.
11.4 If you are a business customer, we are not liable for indirect or consequential loss, loss of profit, revenue, business opportunity or anticipated savings, to the extent permitted by law. Nothing in this clause excludes liability for losses that cannot lawfully be excluded.
11.5 Our £5 million public liability insurance is subject to its policy terms and conditions. The existence of insurance does not alter the rights or liabilities of either party under these terms or the law.
12. Events outside our control
We are not responsible for delay or failure to perform caused by events beyond our reasonable control, such as severe weather, accidents, road closures, fire, flood, strikes, vehicle breakdown, supplier failure, legal restrictions or emergencies. We will take reasonable steps to notify you and reduce the effect of the delay. If the event substantially affects your booking, we will discuss an appropriate alternative or cancellation with you.
13. Privacy and personal information
We use personal information to manage enquiries and bookings, provide our services, process payments, meet legal obligations and communicate with you. Further information about how we collect, use and protect personal information, including your rights, is set out in our Privacy Policy.
14. Complaints
If you are unhappy with our service, please contact us so we can try to put things right:
- Email: info@mjrubbishremovals.co.uk
- Telephone: 07525 034 980
- Address: C10 Star Trading Estate, Ponthir, Newport NP18 1PQ
Please include your name, booking details and a description of the issue. We will review your complaint and respond as soon as reasonably possible. This procedure does not affect your legal rights.
15. General
15.1 If any part of these terms is found to be unlawful or unenforceable, the remaining terms will continue to apply. Any invalid part will be treated as modified only to the minimum extent needed to make it enforceable, where the law allows.
15.2 If we delay or choose not to enforce a right under these terms, that does not mean we have waived that right.
15.3 These terms and the details confirmed in your quote or order form the agreement between you and us for the relevant service. If there is a conflict, the specific terms in your accepted quote or order confirmation take precedence over these general terms to the extent of that conflict.
15.4 Nothing in these terms gives rights to anyone other than you and us, except where the law provides otherwise.
16. Governing law
These terms and any dispute or claim arising from them are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, without affecting any rights a consumer may have to bring proceedings in another court under applicable law.
